1. About these terms
These Terms and Conditions apply to your use of the PixCheckR website at pixcheckr.app, its free scan, paid reports and any related services. By running a scan, creating an account or making a payment, you agree to these terms and to our Privacy policy. If you use PixCheckR on behalf of an organisation, you confirm you have authority to accept these terms for it.
2. What PixCheckR does
PixCheckR is a risk-indicator tool. It reads the public pages of a website, lists the images it finds and looks for signs that an image may belong to a news agency, photo library or other third party. Signs include embedded credit and copyright fields, file-name patterns, where an image is hosted, nearby captions and, for full reports, matching copies found on the web.
PixCheckR identifies possible image-rights issues for your review. Matches are not determinations of ownership, permission or infringement, and an image without a match is not confirmed as licensed.
Scans read public pages only. They may miss images, for example on pages behind a login, on sites with bot protection, on very large sites, or where images load in unusual ways. Results depend on the information available at the time of the scan.
How images are handled. To check an image, PixCheckR downloads it briefly to read its file details and then discards the file. We store the image's web address, the details read and our findings. Free scans keep no image previews. Full reports keep a small preview (up to 240 × 180 pixels) of each image for use in your PDF report, deleted 12 months after the scan. For full reports, image addresses (or, if needed, the image file) are sent to Google Cloud Vision to find matching copies online. Your permission to scan your website does not give PixCheckR or you any rights in third-party images shown on it.
3. Not legal advice
PixCheckR does not give legal advice and does not decide who owns an image or whether you may use it. A high-risk result does not prove infringement. A "No signs found" result does not confirm an image is licensed, and "Marked OK by you" reflects only your own recorded decision. You are responsible for keeping licences and records for images you use, and for getting legal advice about any specific claim or demand.
4. Accounts
- You need an account to buy, view and download a full report.
- Give accurate details and keep your password secure. You are responsible for activity under your account.
- Tell us promptly through our contact form if you think your account has been used without permission.
5. Permission to scan
You may only scan websites that you own or manage, or that you have the owner's permission to scan. You must confirm this, and agree to these terms, before each scan. You must also agree to these terms before buying a full report. If you scan a site on someone else's behalf, you are responsible for having their permission.
6. Acceptable use
You must not:
- use PixCheckR to identify, build or pursue claims against websites you don't own or manage, or to harass anyone;
- try to overload, disrupt or get around the limits of PixCheckR or any scanned website;
- try to access other users' reports or data, or probe, scan or test the security of PixCheckR without our written permission;
- copy, resell or automate access to PixCheckR, or use it to build a competing service;
- use PixCheckR for anything unlawful.
Free scans are limited per day and per website to prevent misuse. We may block scans or accounts that we reasonably believe breach this clause.
7. Plans, prices and payment
- Free scan: up to 50 pages, file checks only, with an overall likelihood, the number of images to review and the likely owners.
- Full report: a one-off payment per website (one domain), currently US$25. It includes up to 500 pages per scan, web matching, a list of every flagged image with reasons and likely owners, a decision record, PDF and CSV reports, and three full scans within 30 days of purchase.
- Monitor: a monthly subscription per website (one domain), currently US$9 a month. Each month we check the whole website, with no plan page limit (a technical safety stop of 10,000 pages applies to protect the service from endless page loops). Images added since the previous check are checked and web-matched, and we email you if any may belong to a third party. The first check records a starting point and does not report on images already on the site; use a full report for those. Monitor doesn't include PDF or CSV reports.
- Prices are in US dollars (USD) and shown at checkout. Your bank may charge a currency conversion fee. Any GST or other tax that applies will be shown at checkout.
- The full report is a one-off purchase. There is no subscription, automatic renewal or cancellation fee.
- Monitor renews automatically each month until you cancel. You can cancel any time from My reports (through Stripe's secure billing page) or by contacting us. Cancelling stops future payments; monitoring continues to the end of the month you've paid for, and there is no cancellation fee. We'll tell you before any price change takes effect for your subscription.
- Payments are processed by Stripe. We don't see or store your card details. Your report is unlocked once Stripe confirms payment.
- Plans marked "coming soon" are not yet available to buy. We may change prices or plans for future purchases; changes don't affect a report you have already paid for.
8. Refunds
If a paid scan or a monthly Monitor check fails for a reason within our control and we can't fix it within a reasonable time, we will refund you (for Monitor, the affected month). A scan that runs correctly but finds few images because of the website's own settings (for example bot protection or login-only pages) is not a failure within our control, but contact us and we'll try to help. Refunds are made to the original payment method. Nothing in this clause limits any rights you have under clause 9.
9. Consumer law
If you are a consumer, nothing in these terms limits your rights under the Consumer Guarantees Act 1993, the Fair Trading Act 1986 or other New Zealand consumer law. Where the Consumer Guarantees Act 1993 applies, we will supply the service with reasonable care and skill. Statements in these terms about what PixCheckR does and doesn't show describe the service's limits; they don't excuse a scan that we run carelessly.
10. Reports and intellectual property
- We own the PixCheckR website, software, scoring methods, branding and report templates.
- Once paid for, you may use, copy and share your reports for your own organisation's purposes, including with your advisers, insurers, web designers and anyone sending you a claim.
- Images shown in reports remain the property of their owners. Thumbnails and links are shown only to help you identify images on your own site.
- You keep ownership of the notes and decisions you record. You allow us to store and process them to provide the service.
11. Third-party services
PixCheckR relies on third-party providers, including Supabase (accounts and database), Vercel (hosting), Stripe (payments) and Google Cloud Vision (web matching for full reports). Their availability and results are outside our control. Links to third-party websites in reports are given for convenience; we are not responsible for their content.
12. Privacy
We handle personal information in line with the New Zealand Privacy Act 2020 and our Privacy policy.
13. Availability and changes to the service
We aim to keep it available and accurate but don't promise it will be uninterrupted or error-free. We may improve, change or withdraw features. If we withdraw the full report service, we will give you reasonable notice to download your reports.
14. Limitation of liability
To the extent permitted by law:
- we are not liable for any claim, demand, licence fee, settlement or legal cost relating to images on your website, whether or not PixCheckR identified them;
- we are not liable for any indirect or consequential loss, or for loss of profit, revenue, data or goodwill;
- our total liability to you in connection with PixCheckR is limited to the amount you paid us for the report concerned in the 12 months before the claim.
Nothing in these terms limits liability that cannot be limited by law.
15. Indemnity
If you are using PixCheckR for business purposes, you agree to indemnify us against claims by third parties arising from your scanning of a website without permission or your breach of clause 6.
16. Suspension and closure
You can close your account at any time through our contact form. We may suspend or close an account that breaches these terms, giving notice where reasonable. Clauses 3, 10, 14, 15 and 18 continue after closure.
17. Changes to these terms
We may update these terms from time to time. The version date at the top shows the latest version. Changes apply from the date they are posted and don't affect purchases already made.
18. General
These terms are governed by the laws of New Zealand, and the New Zealand courts have non-exclusive jurisdiction. If any part of these terms is unenforceable, the rest continues to apply. A failure to enforce a term is not a waiver.
